The CAGIC held a press conference at the gate of the inter-Korean immigration office in Paju, Gyeonggi Province, to mark the third anniversary of “the 4.27 Panmunjom Declaration” and urged the re-opening of the Gaeseong Industrial Complex.
"Since the government is doing nothing, we have no choice but to come forward."
Tenants in the GIC will lobby the U.S. government alone. Although it has been over five years since the GIC was suspended, the possibility of re-opening the complex remains unclear. It is pointed out that the government's response such as compensation for losses is insufficient. "What did the government do to save the GIC, a symbol of inter-Korean economic cooperation?" said tenants of the GIC.
According to some tenants of GIC on July 31, the CAGIC hired a U.S. lobbyist. The lobbyist that the association has joined hands with is Pillsbury, a large U.S. law firm. The association paid Pillsbury U$200,000 (approximately 230 million Korean Won) in return for lobbying against the U.S. legislature and administration. As most of the members of CAGIC were in bad situation so that they could not pay their membership fee, about 10 companies in better conditions made payments to cover the expenses together.
The reason why the association is spending a large sum of money in spite of its poor financial conditions is simple. It’s because they are desperate for the re-opening of the GIC. In fact, most of the tenants want to re-enter the industrial complex. According to a survey conducted by the Korea Federation of SMEs for 111 tenants in the GIC in February this year, 91.9% of the respondents expressed their intention to re-enter.
However, the government's response is lukewarm. It has been over five years since the GIC was suspended, but the government has yet to come up with a solution. Although high-ranking government officials sometimes mentioned the re-opening of the complex as an issue, it failed to lead to effective measures.

1st anniversary of the bombing of the inter-Korean liaison office in Gaeseong = The inter-Korean joint liaison office and the GIC support center, which was damaged by the impact of the bombing, have been left un-cared for a year.
The government's compensation for losses is also said to be insufficient. The government paid 583.3 billion won until last year under the principle of “compensation for direct damage caused by the suspension” whey they stopped operating the complex. On the other hand, the damage estimated by the association is 1.5 trillion Korean Won. Investment assets such as buildings and facilities that were left at the complex are about 593.6 billion Korean Won.
As the damage increases every year, the association intends to produce tangible results in any way sooner or later. "We signed the contract with the intention of ending the GIC issue within May next year," said an official at the CAGIC. "We also expect that it can be carried out quickly as the law firm has general consensus about the difficulties of the tenants in GIC."
The association will begin lobbying in earnest from September. They are expecting to meet U.S. government officials to emphasize the need to ease sanctions on North Korea to re-open the GIC. As the GIC has been suspended due to the strengthening of U.N. and U.S. sanctions on North Korea, it seems their strategy is to persuade the international community to make a breakthrough starting with the U.S.
According to the association, inquiries from government officials, including the Unification Ministry, continued when the news of the association hiring a lobbyists was announced. However, no one took the lead in helping the association. In the end, it is expected to be a "lonely fight" for the association. This is why it is hard to avoid criticism that the government used small and medium-sized enterprises for political interests. "One-fifth of the tenants in GIC are in a situation of closing their businesses or equivalent," said an entrepreneur at the GIC. "The government should be active even now that the direct inter-Korean contact line has been restored."

South-North Governments should Initiate the Talks to Realize the [Sharing of Quarantine and Prevention Products] for the Workers of Gaeseong in North Korea and Their Families.
The 20 executives of the Corporate Association of Gaeseong Industrial Complex (Chairman JAE CHUL, LEE) held a press conference on June 15th at 10:00 AM commemorating the 21st Anniversary of the [June 15th South-North Joint Declaration] at the south end of the Unification Bridge which were commuted everyday in the past by the workers of Gaeseong Industrial Complex, and they pleaded as “the South-North Governments should initiate the talks to realize the [Sharing of Quarantine and Prevention Products] for the workers of Gaeseong Industrial Complex in North Korea and their families”.
The Chairman, JAE CHUL, LEE, stressed that “The Gaeseong Industrial Complex was born as a precious gift of the June 15th South-North Joint Declaration which today we are commemorating its 21st Anniversary. Throughout its closure for over 5 years, the Entrepreneurs of the Gaeseong Industrial Complex are desperately dying and the ember for its restoration is also withering” and argued that “although it is too late now, the governments of North and South should immediately and actively participate in the talks for the restoration and normalization of the Gaeseong Industrial Complex”.

The Gaeseong Industrial Complex was born as a precious gift of the June 15th South-North Joint Declaration which today we are commemorating its 21st Anniversary. Throughout its closure for over 5 years, the entrepreneurs of the Gaeseong Industrial Complex are desperately dying and the ember for its restoration is also withering. The Governments of both South and North Korea should initiate the sincere Talks to realize the [Sharing of Quarantine and Prevention Products] for the workers of Gaeseong Industrial Complex in North Korea and their families.
Today is the historical 21st anniversary of the June 15th South-North Joint Declaration. The Gaeseong Industrial Complex is the only successful South-North Economic Cooperation Project which was born as a result of the June 15th South-North Joint Declaration.
However, the Industrial Complex suffered a critical damage due to the illegal closure by the government 5 years ago, and the enterprises are barely surviving under the perilous aftereffects of the closure, where nowadays the increasing number of suspended and closed enterprises are evidencing the withering ember for the restoration of the industrial complex. If the enterprises which are the principal actors of the industrial complex disappeared and if the number of abandoning companies increased by the time, then who would be able to enter once again when the Gaeseong Industrial Complex is restored in the future?
We consider now is the time that the South and North should take the initiative and act. No, nevertheless it is too late. The governments of North and South should immediately and actively participate in the talks for the restoration and normalization of the Gaeseong Industrial Complex.
We, the enterprises located within Gaeseong Industrial Complex do hereby take a small but very meaningful initiative for the workers of Gaeseong Industrial Complex in North Korea and their families, to prepare the possible opportunity of restoration of talks. We hereby would like to implement the sharing of quarantine and prevention products including masks and others. We sincerely hope to deliver the masks which were produced by the enterprises in Gaeseong to the workers of the complex who are our true families.
We consider that the first step is always the most important although it might be weak or miscellaneous. It is necessary that the small withering ember is revived once again, that the talks are performed and the trust is restored once again between the Two Koreas. We sincerely hope that the humanitarian acts by domestic and international civic and social groups could follow the good initiative of the Enterprises located in Gaeseong Industrial Complex, and that the attention of the international society could increase respectively.
For last, we sincerely hope that the Gaeseong Industrial Complex could be restored/normalized as soon as possible and that we could produce therein the quarantine and prevention products such as mask and others, and therefore both South and North could overcome the COVID-19 and restore our common and normal life, and thus we hereby plead sincerely as follows.
1. The North Korea should respond to the [Sharing of Quarantine and Prevention Products] performed by us, the Enterprises located in Gaeseong.
2. The South Korean government should actively discuss and consult with North Korea to realize the [Sharing of Quarantine and Prevention Products] by the Enterprises located in Gaeseong.

Unconditionally Resume the Gaeseong Industrial Complex!
The 20 executives of the Corporate Association of Gaeseong Industrial Complex (Chairman JAE CHUL, LEE) held a press conference on April 27th at 14:00 PM commemorating the 3rd Anniversary of the [April 27th Panmunjeom Declaration of the Two Koreas] at the gate of the Inter-Korean Transit Office which were commuted everyday in the past by personnel of Gaeseong Industrial Complex, and they pleaded that “Gaeseong Industrial Complex should be Immediately Resumed”.
The Chairman JAE CHUL, LEE of the Corporate Association stated in the announced statement that “the disastrous situation has passed its limits as the damage of the companies has aggravated by the time. We all must know that, while the government only wasted the time by looking to left and right and reading the mind of U.S., and the lives of our companies and entrepreneurs were drastically suffocating and neglected in vain” and argued that “The government was the one entity which illegally closed the industrial complex but we the entrepreneurs of Gaeseong Industrial Complex are the suffering ones cornered to the deadly situation, but this unreasonable situation must be immediately corrected”.
Thereafter, he urged as “the both governments of South and North Korea should immediately and unconditionally resume the Gaeseong Industrial Complex and immediately permit the visit of the entrepreneurs of Gaeseong to maintain the facilities and prepare for the reoperation of the industrial complex”.

ALL ENTERPRENEURS OF GAESEONG INDUSTRIAL COMPLEX ARE DESPERATELY DYING.
THE GOVERNMENTS OF SOUTH-NORTH SHOULD UNCONDITIONALLY AND IMMEDIATELY RESUME THE GAESEONG INDUSTRIAL COMPLEX.
Today is the 3rd Anniversary of the Panmunjom Declaration.
3 years ago, we the entrepreneurs of businesses located within Gaeseong Industrial Complex were full of the hope that we could immediately go back to and work in the Gaeseong Industrial Complex but after 3 years from that day, there is nothing left but only suffering under hopelessness.
We the enterprises located at Gaeseong Industrial Complex suffered from incalculable damages due to the illegal closure by the government 5 years ago, but the relevant government subsidies were only partial and miscellaneous, and thereafter, we survived each day under precarious conditions due to the increasing and aggravating aftereffects of the closure, but even so, we endured by believing the promises of the South-North leaders and by waiting for the soonest normalization of the Gaeseong Industrial Complex.
But now we do not have any patience or strength to endure it anymore, and the disastrous situation has passed its limits as the damage of the companies has aggravated by the time. We all must know that, while the government only wasted the time by looking to left and right and reading the mind of U.S., and the lives of our companies and entrepreneurs were drastically suffocating and neglected in vain.
The government was the one entity which illegally closed the industrial complex but we the entrepreneurs of Gaeseong Industrial Complex are the suffering ones cornered to the deadly situation, but this unreasonable situation must be immediately corrected. We will march and advance to normalize and resume the industrial complex which has been illegally closed. We cannot wait any longer, we have no more space to step back.
Thus, we the entrepreneurs of Gaeseong Industrial Complex hereby urge strongly as follows to the governments of both South and North Korea with our sincere will and desire for the normalization of the Gaeseong Industrial Complex.
One, the both governments of South and North Korea should immediately and unconditionally resume the Gaeseong Industrial Complex!

Members of CAGIC visited “the 3-step-1-bow event” of Gyeonggi Province's Peace Deputy Governor “calling for the resumption of the Gaesong Industrial Complex”
The corporate representatives of the Emergency Measure Committee of Enterprises Located in Gaeseong Industrial Complex (Chairman, GI SEOB, JEONG), on December 15th (Tuesday) from 14:00 until 16:00 PM at the south end of the Unification Bridge, visited and encouraged the “Event of 3-Steps-1-Bow to Urge the Announcement of Resume of the Gaeseong Industrial Complex” performed by Gyeonggi Province's Peace Deputy Governor, JAE GANG, LEE.
The corporate representatives could not participate in the event for the compliance with the COVID-19 quarantine guidelines, but the Vice-governor for Peace of Gyeonggi-do province continued performing the 3 steps and 1 bow event for over 2 hours under the sensory temperature which suddenly decreased due to the strong wind and the temperature of -10ºC. Together with the bowing event there was also performed the one protester’s protest with picket and the performer bowed 125 times symbolizing the 125 enterprises in Gaeseong and they all exclaimed for the “Resume of the Gaeseong Industrial Complex”.
Before the event, Gyeonggi Province's Peace Deputy Governor, JAE GANG, LEE was protesting by denouncing the United Nations and urging the resuming announcement of the Gaeseong Industrial Complex as a one-protester at the Unification Bridge while operating in his temporary office within the Pyeonghwa Nuri Park of Imjingak (Imjingak Pyeonghwa Nuri Park) Pavilion.
The chairman GI SEOB, JEONG stated that “the representatives of the enterprises in Gaeseong also prepared to participate in this event of 3-Steps-1-Bow to urge for the resume of the Gaeseong Industrial Complex, but under this severe situation of continuous epidemic of COVID-19 we unfortunately could not participate in the event to comply with the quarantine guidelines”.
And he revealed that “the enterprises located at Gaeseong are in crisis of maintenance or abolition due to the long closure of the industrial complex for over 5 years and the pandemic of COVID-19, but I personally appreciate much that Gyeonggi Province's Peace Deputy Governor took the initiative in this manner, and therefore I will strengthen my resolution to make greater efforts as a participant in the Gaeseong Industrial Complex, and I will make my best endeavor and anything possible to resume the Gaeseong Industrial Complex with the soundest mind that the resume of the Gaeseong Industrial Complex is the restart of the peace and economic cooperation between the Two Koreas”. Dear, Respected President Moon Jae-In!
We are entrepreneurs of the companies which entered to or established business sites in the Gaeseong Industrial Complex.
It has been 5 years since the Gaeseong Industrial Complex has been suddenly shutdown.
We consider that you would be very agonized and tormented to resolve the accumulated and numerous administrative affairs including the problem of COVID-19, but as we cannot wait indefinitely for the decision of our government any longer, we hereby would like to inform you about our desires and opinion through this brief letter.
The sudden closure of Gaeseong Industrial Complex which happened 5 years ago was an illegal political administrative act that was imposed on interested parties without prior notice. It was due to the spontaneous and dogmatic decision of the former president, not because of the international sanction on North Korea.
We guess you clearly know how and why we have invested on and entered to the Gaeseong Industrial Complex, Mr. President.
We were very uncertain and afraid of the investment on North Korea, but we believed the promise of our government at that time that “50 years of autonomous corporate management and stable operation shall be secured and guaranteed and all responsibilities shall be borne by the government” and accordingly we built factories and facilities in the Gaeseong Industrial Complex which was only an extensive empty wild plain.
During the administrations of the former presidents, Lee Myung-Bak and Park Geun-Hye, we the enterprises in Gaeseong Industrial Complex suffered from the unkind treatments and prejudices, but we endured working with our own sense of mission that we were building the basis for the common prosperity and peace of the Two Koreas.
The Park Geun-Hye administration promised to guarantee and secure the stable operation of the Gaeseong Industrial Complex together with North Korea in 2013, but they suddenly broke that promise and close the entire Gaeseong Industrial Complex.
During the entire season of winter of that year, we raised our candles thinking that “this is not a proper country” in the coldest streets, and we gladly welcomed the inauguration of the new Moon Jae-In administration with our greatest impressions and hopes.
But we could not receive any fair compensation for the incalculable damage we suffered due to the illegal closure of the industrial complex performed by the government, but we only received subsidies in form of loans and insurance money which were not nearly enough to cover our actual damages. But we have waited long and endured all that time with the only hope that the Gaeseong Industrial Complex will be resumed soon.
Our hearts were almost exploding for the hope that the Gaeseong Industrial Complex will be soon resumed when we saw the South-North Korean Summit in 2018, the U.S.-North Korea Summit and the September 19th Pyeongyang Declaration, but the hope of resume of the Gaeseong Industrial Complex only became a torture of vain hope since the breakdown of the Hanoi Summit.
We expected to at least see or hear the will of the government for the resume of Gaeseong Industrial Complex in the New Year’s Speech of this year given by our Mr. President, but you did not mention a single relevant word.
Mr. President!
We all know well the difficulties of our government that the government should ask for the consent and permission of the U.S. for the resume of the Gaeseong Industrial Complex.
But we also believe that our government should at least reveal its will to resume the industrial complex instead of telling the entrepreneurs who waited day by day and year by year suffering from all the damages caused by the illegal closure of the industrial complex by the former administration, just to wait indefinitely without any promise.
We took our first steps to Gaeseong believing the promise of our government, and now we hereby plead you to perform proper responsibility and obligation as the entrepreneurs who lost business sites in Gaeseong due to the compulsory measures.
Mr. President!
It already passed 5 years since the closure of the industrial complex. All the companies which entered to or established their business sites in Gaeseong, except the conglomerates which have their production facilities diversified and operated in different locations, are suffering from severe financial difficulties.
The businesses of over 30% of the companies, including the companies in rehabilitation are actually suspended or closed.
Last year, to add the difficulties, the COVID-19 aggravated the financial and managerial difficulties but there was no government subsidy or support throughout the entire period of crisis.
Although it is too late even for now, the honorable Mr. President must be clearly aware of the fact that the Ministry of Economy and Finance and the Ministry of Unification, on the early 2018, took the tyrannical measure of receiving from the entrepreneurs, against their will, the written confirmation stating that the entrepreneurs of Gaeseong Industrial Complex shall not present any claim against the government subsidy for the damages caused on investment and current assets of the companies with the good excuse on the additional subsidy for the damages on the current assets, and thereafter they clearly lied as if they harmoniously completed the subsidies for the damaged businesses. This is what should never happen or exist under the Moon Jae-In administration.
Dear and respected Mr. President!
Before giving up all the hopes on the resume of Gaeseong Industrial Complex, we would like ask the government the firm will to resume the complex. Please let us know, personally and directly, if we should abandon all hopes and claim for the liquidation and fair compensation for the industrial complex, or if we should wait for an undetermined period of long-suffering by believing the government.
We sincerely hope for the success and prosperity of the Moon Jae-In administration.

THE CORPORATE ASSOCIATION OF GAESEONG INDUSTRIAL COMPLEX (CORP.) CHAIRMAN, GI SEOB, JEONG] DELIVERED FUNDS AND RELIEF SUPPLIES TO THE REGION OF DAEGU WHICH SUFFERED GREATEST DAMAGES DUE TO COVID-19 PANDEMIC.
THE GAESEONG INDUSTRIAL COMPLEX IS CAPABLE OF PRODUCING LARGE AMOUNT OF MASK AND OTHER QUARANTINE-PREVENTION PRODUCTS, WE MUST PERSUADE THE INTERNATIONAL SOCIETY AS SOON AS POSSIBLE.
The Corporate Association of Gaeseong Industrial Complex (Corp.) (Chairman, GI SEOB, JEONG) revealed that the association and its members took the good initiative to help the Daegu Metropolitan City which suffered the greatest damages due to the COVID-19 pandemic and they contributed approximately KRW 17 million, 5,000 masks (donated by Evergreen Co., Ltd.) and 1,000 anti-contamination clothing for quarantine to the Daegu Branch of Community Chest of Korea.
The chairman GI SEOB, JEONG of the Corporate Association of Gaeseong Industrial Complex stated that “although most of the companies did not have enough affordability as the industrial complex has been closed for more than 4 years, but as entrepreneurs and citizens of Korea, we have implemented this donation to help at all the region of Daegu which is suffering from the greatest damages” and he added that “we hope that we could overcome this national disaster and return to our normal lives as soon as possible”.
The official of the Corporate Association of Gaeseong Industrial Complex stressed that “the Gaeseong Industrial Complex is a place with sufficient capacity to produce all the quarantine and prevention products such as masks, anti-contamination clothing, detergent, etc., and we could have minimized the damage of this national disaster due to the COVID-19 if they did not close the Gaeseong Industrial Complex” and claimed that “it is not too late, even now and before all the government should appeal to the international society such as U.N. Security Council and Sanction Committee for the reoperation of the Gaeseong Industrial Complex which is capable of massive production of quarantine-prevention products such as masks, and should propose to North Korea that we should overcome together this crisis of COVID-19 which is expanding to the entire world through the resuming of the Gaeseong Industrial Complex, and therefore the government should at least partially resume the industrial complex”. The visiting group to the U.S.A., composed by the Corporate Association of Gaeseong Industrial Complex (chairman, GI SEOB, JEONG) and the Gaeseong Industrial Complex Foundation (chairman, JIN HYANG, KIM) visited Washington and Los Angeles, U.S.A., from June 10th until 16th and had the most meaningful venues of explaining on the value of peace and role of Gaeseong Industrial Complex which drives the denuclearization of North Korea to the Asia-Pacific Subcommittee, Department of State and numerous thinktanks of the U.S.A.
In the briefing session held by the commissioner of the Asia-Pacific Subcommittee of the U.S. Federal House of Representatives, Mr. Brad Sherman on June 11th, participated the Federal Representatives as Judy Choo and Andy Kim and numerous executive officers of the members of Asia-Pacific Subcommittee.
The chairman JIN HYANG, KIM who presented the keynote speech of the briefing session explained on the value of peace which is the purpose of establishment of the Gaeseong Industrial Complex, stressed that “the purpose of Gaeseong Industrial Complex is peace as so is the purpose of the denuclearization” and mentioned that “the resume of Gaeseong Industrial Complex will produce the effect of virtuous cycle which may lead the denuclearization of North Korea”.
The chairman GI SEOB, JEONG explained his experiences of operating enterprise in the Gaeseong Industrial Complex and pleaded that “the enterprises in Gaeseong Industrial Complex are desperately wishing the resume of the Gaeseong Industrial Complex, and I hope you could understand that the Gaeseong Industrial Complex was a meaningful venue where the people of North Korea could develop the correct understandings on the market economy”.
The commissioner Brad Sherman who participated in the briefing session mentioned that “I agree with the CVID of the U.S. government, but we need to have the most reasonable bargaining position if possible. If the Gaeseong Industrial Complex is resumed, it will be the first step for the North Korean people and government”. The representative Judy Choo evaluated the session as “it was a very educational briefing session”.
In June 12th, he had the opportunity to explain the value of Gaeseong Industrial Complex to the thinktank of U.S. (USIP, Stimson Center, International Crisis Group) and the Korean experts of the U.S. expressed their high interests on the manner of wage payment and distribution for the workers of North Korea in Gaeseong Industrial Complex.
In June 13th, when visited the U.S. Department of State, the Deputy Assistant Secretary of East Asia-Pacific Mr. Mark Napper greeted amicably the visitors from the Corporate Association of Gaeseong Industrial Complex with the fluent salute in Korean “welcome, you have traveled a long way to the United States of America”. Thereafter they introduced the ‘Value of Peace of the Gaeseong Industrial Complex and the Cases of Corporate Operation’ to the Korea Desk Director, Mr. Joy Yamamoto.
In a separate incident, the association explained the value of peace and comparative economic advantage of Gaeseong Industrial Complex to the Korean Businessmen Associations in the United States of America in Washington on June 12th, and in Los Angeles on June 15th, and also stressed that North Korea was hoping for the investment of American enterprises on the Gaeseong Industrial Complex.
The visiting group of Gaeseong Industrial Complex to the U.S. assessed that they achieved the improvement of understandings on the value and roles of the Gaeseong Industrial Complex in the government and people of the United States of America through this visit to the United States of America, but they also expressed the regret that the time of visit was too short to perform any profound discussion, and finally they expressed their will to continue promotion and cooperation towards the United States of America in private level. Survey Results and Opinion on the Current Managerial Status of Enterprises Located in Gaeseong Industrial Complex and Future Prospect
The Emergency Measure Committee of Corporate Association of Gaeseong Industrial Complex (chairman, HAN YONG, SHIN) jointly with the Korea Federation of Small and Medium Business requested to an external professional survey agency the implementation of the “Survey and Opinion Investigation on the Managerial Status of Enterprises Located in Gaeseong Industrial Complex” and announced its results as follows.
According to the results of the survey, most of the enterprises (60.4%) were currently making efforts to resume their businesses by transferring production facilities to overseas and securing alternative facilities, etc., but the results also revealed that significant number of enterprises (13.9%) were driven out to the situation of closure due to the suspension of production, etc. Most of the enterprises which are operating factories had difficulties as insufficient operation fund and in securing customers, and the enterprises which could not secure alternative production facilities stated as their greatest difficulty the problem in securing the equipment funds.
Also, for the case the Gaeseong Industrial Complex is resumed, the 26.7% of the enterprises expressed their will to “Re-enter Immediately” and 69.3% expressed as “We Will Re-Enter After Verifying the Resume Conditions Agreed Between the Government and North Korea”, where there could be verified that most of the enterprises were positive in re-entering to the Gaeseong Industrial Complex. But the point that the opinion to verify/observe the situation has drastically increased when compared to the previous survey (survey 1 year ago: 44% will re-enter immediately / 49% will re-enter after verifying the situations), demonstrates the reality that the tiredness has been accumulated when compared to the survey of the previous year.
Especially, the difficulties which were revealed by the enterprises which expressed the will of re-entry were the “financial difficulty such as preparation of fund for re-entry” and the “difficulty which occurs due to excessive facility investment such as duplicated (overlapped) investment”, therefore it was verified that the political support was surely necessary in addition to the formation of conditions between the Two Koreas for the re-entry to the Gaeseong Industrial Complex.
As reason of hoping for re-entry or re-location, the 79.4% of the enterprises selected the “Advantage and competitiveness of the Gaeseong Industrial Complex compared to other domestic and international industrial complexes”, and it was followed by answers as “Because there is no alternative except the Gaeseong Industrial Complex due to depletion of surplus for investment” (10.3%) and “To cover the insufficiency of the government’s damage subsidy by measures as sales of facilities and others” (5.2%) sequentially.
Therefore, the Emergency Measure Committee of Corporate Association of Gaeseong Industrial Complex, on the basis of the aforementioned survey results, urged to the government that “there must be initiated as soon as possible the discussions for the resume of the Gaeseong Industrial Complex” and “to prepare the subsidy-support alternatives for the damage restoration and management normalization of the damaged enterprises in case of the resume of the complex”.
Moreover, as it is considered that there might be formed a proper environment to initiate the discussion for the resume of the Gaeseong Industrial Complex thanks to the successful Panmunjeom Declaration, the enterprises of Gaeseong Industrial Complex stated that they will make all possible efforts to play the role as the pioneers of the “New Economic Map of the Korean Peninsula” as the symbol and trend-setters of the Economic Cooperation between the Two Koreas by resuming surely the Gaeseong Industrial Complex which is a valuable and precious asset of the common prosperity of the people. ON THE 3 YEARS OF CLOSURE OF THE GAESEONG INDUSTRIAL COMPLEX
Today is accurately the 3rd year since the closure of the Gaeseong Industrial Complex. Since the South-North Korea Summit and the U.S.-North Korea Summit of last year the enterprises endured all the difficulties of the closure but they only endured and bore the torture of vain hope without giving up the hope of the resume of the complex. Thus, we hereby urge as follows by desperately hoping for the soonest resume of the Gaeseong Industrial Complex.
One, We Sincerely Urge for the Soonest Normalization of the Gaeseong Industrial Complex
The project of Gaeseong Industrial Complex which was implemented regardless of the sanction on North Korea by the international society, is a humanitarian economic cooperation project to support the public livelihood of the people of North Korea and it is also a way of solution for us the small and medium enterprises. We sincerely hope that the normalization of the Gaeseong Industrial Complex could be performed as soon as possible as promised by the representatives of the Two Koreas.
One, We Urge for the Survival Measure for the Enterprises in Crisis of Bankruptcy
For the past 3 years, the entrepreneurs of Gaeseong Industrial Complex made their all-possible efforts to normalize the management even under the deadliest crisis and difficulties, but some of them are already in crisis or risk of bankruptcy. We urge for the immediate establishment of the survival measures for the enterprises.
One, We Urge for the Immediate Approval to Visit North Korea to Verify Our Assets
We applied numerous times for visiting North Korea for facility inspection, but all of them were decided as disapproved and postponed. We hope to visit as soon as possible to the valuable workplace of the located enterprises and the workers. We urge to approve the visit to Gaeseong Industrial Complex as soon as possible.

The Emergency Measure Committee of Corporate Association of Gaeseong Industrial Complex also cited the recent announcement of the Innovation Policy Committee of the Ministry of Unification and stated that “we cannot express nothing but horror and astonishment that the sudden and complete suspension of the Gaeseong Industrial Complex has been decided only by the unilateral oral order of the former president Park Geun-Hye by infringing all the legitimate procedures stated in the National Constitution” and added that “although it is a policy adopted by the former administration, the current government shall officially apologize as the first step to relieve the damages of the entrepreneurs and to resume the Gaeseong Industrial Complex”. Position of the Corporate Association of Gaeseong Industrial Complex on the Dispute on the Gaeseong Industrial Complex
The (Corporation) Corporate Association of Gaeseong Industrial Complex hereby announces its position on the dispute on number of employed personnel and subcontractors which were presented recently on the Gaeseong Industrial Complex.
1. On the dispute about approximately 5,000 subcontractors, the Corporate Association implemented the survey on the located enterprises from the early August of the last year until the end of this August, where 66 enterprises responded and when measured this value in the 125 located enterprises, it was estimated and verified that there are approximately a total of 7,700 subcontractors and 77,000 employed personnel.
When inquired to the government official on the statement on 460 enterprises, the official revealed that “we only stated the number of the enterprises with the ownership on the raw and subsidiary materials which were left in Gaeseong which was verified through the actual damage survey of last year”, and this clearly and only meant the number of main contractors according to the characteristics of the Gaeseong Industrial Complex where most of the enterprises were foundry manufacturers, and there was clearly omitted the number of the subcontractors which directly purchased and delivered their equipment and materials into the Gaeseong Industrial Complex.
2. The content presented by a certain candidate, that approximately 1 million of jobs will be created in North Korea in relation with the Gaeseong Industrial Complex, is critically different to the “estimation of approximately 350,000 jobs by the Hyundai Asan Group”, and although it seems that the number of 1 million personnel resulted from the simple multiplication from 1 million PY extent to 20 million PY extent, when considered that the factory/facility section will only be extended by sextuple (6X), it is clear that the respective estimation has been excessively exaggerated.
Especially, when considered that the Gaeseong Industrial Complex is a model of domestic industrial complex where most of the raw and subsidiary materials are procured and delivered from South Korea and only the workers of North Korea participate in the production process, and when considered that this is a coexisting cooperative model where significant number of jobs can also be created in South Korea, the logic of a certain candidate that 1 million jobs will disappear from South Korea when 1 million jobs are created in North can be nothing but lack or insufficiency of understanding on the current situations of the Gaeseong Industrial Complex and the domestic small and medium enterprises.
Most of the enterprises located in the Gaeseong Industrial Complex are companies which are required to expand to overseas as the payability of the industry is improper when stayed within the country, and if they left overseas different to the model of Gaeseong Industrial Complex, they will have to precure all the raw and subsidiary materials from local vendors, and thus, innumerable subcontractors will be bankrupt and uncountable jobs will disappear from the domestic market.
We sincerely hope that the Gaeseong Industrial Complex which was closed for over a year could be resumed, and therefore the complex could contribute for the national economy as a leading force of the north economy, and there could be other and more opportunities to create decent jobs in the domestic market. Announcement of Survey on Located Enterprises and Position of Enterprises on the Government Briefing after 1 Year of Total Suspension of the Gaeseong Industrial Complex
The Emergency Measure Committee of Corporate Association of Gaeseong Industrial Complex (chairman, GI SEOB, JEONG) revealed the “Results of Survey on Current Condition of Located Enterprises and Requests” and the “Argument Against the Government Briefing Announced on February 7th, (Tuesday)” through the press conference commemorating the 1st year of total suspension of the Gaeseong Industrial Complex. The 20 members of the Emergency Measure Committee of Corporate Association of Gaeseong Industrial Complex held the press conference on February 9th, 11:00 AM at the Medium Conference Hall of the Korea Federation of Small and Medium-Sized Businesses located at Yeoui-do, Seoul City and announced the results of the survey on the current conditions and difficulties of the enterprises located in Gaeseong after 1 year of the total suspension of the Gaeseong Industrial Complex.
The Committee revealed the results of the survey on located enterprises that, even when excluded the asset losses during the past 1 year of total suspension of Gaeseong Industrial Complex, approximately and averagely 2 billion Korean Won was the loss per enterprise and when simply calculated the damages and losses of all located enterprises it was estimated as approximately 250 billion Korean Won. The Committee announced that it was the actual damage suffered by the enterprises during the past year different to the argument presented by the government and that there shall be performed actual compensation of damages through the establishment of special acts for compensation.
Additionally, the Committee stated that 2/3 (67%) of the enterprises have the will and intention to re-enter into the Gaeseong Industrial Complex when it is resumed, and the number of enterprises willing to re-enter will increase if included the enterprises which will decide after verifying the situations (26%), and therefore refuted some arguments that “this is not the time to examine for the ‘resume of Gaeseong Industrial Complex’ when the located enterprises do not desire to re-enter” by revealing the actual position of the located enterprises.
The Committee also revealed that most of the responding enterprises (81%) stated the reason of desiring re-entry as “the high productivity, lower distribution costs and expert workers of the Gaeseong Industrial Complex compared to the labor cost are the principal factors of the managerial environment which is more competitive than the domestic and international markets, therefore the enterprises desire to re-enter to Gaeseong Industrial Complex, and the opinion of the minority was to reduce the loss by first reoperating the complex with the damage subsidy from the government which only covers the 1/3 of the actual damage, ▲and another reason of re-entry was the depletion of investment condition of the domestic and international markets due to the alternative investments”.
Moreover, the Committee stated that the briefing material announced by the government after 1 year of suspension of the Gaeseong Industrial Complex on the past February 7th (Tuesday) was the unilateral and arbitrary argument of the government, and the measure of sudden and complete suspension of the Gaeseong Industrial Complex was clearly an act which did not comply with the legal procedures, and the relevant subsidy alternative was only an interest-free loan which only covered the 1/3 of the actual damages.
Thus, the Emergency Measure Committee of Corporate Association of Gaeseong Industrial Complex, based on such survey results, stated on their decision to strongly urge to the government for the “resume of Gaeseong Industrial Complex” and the establishment of “special compensation act” to compensate the actual damages and urged that “if the policy less beneficious and full of losses, even now the measure of total suspension of Gaeseong Industrial Complex should be entirely reexamined and the discussion for resume should initiate.” FIN.

Position of Enterprises on the Results of Actual Condition Research and the Announcement of Government’s Comprehensive Measure
We hereby reveal our position as follows on the results of actual condition research and the announcement of the government’s comprehensive measure which were announced today.
Even the amount which the government confirmed arbitrarily (KRW 777.9 billion) by excluding most of the suggestions of the companies was antimonic as they decided the compensation amount as if they were negotiating among government ministries and the actual parties cannot accept such contradiction at all. A responsible government would be providing fair compensation for the damages which occurred due to the political changes.
Especially, due to such limitation of compensation amount, the amount invested by the government was limited by only KRW 520 billion which is 67% of the amount confirmed by the government, and the located enterprises which are required to repay most of the amount of damages to the financial entities and subcontractors have no option but to claim as follows: “as the government only compensated the 67% of the amounts, you should bear the rest of the damages or claim particularly to the government for compensation”.
Moreover, there is no alternative for the costs claimed by the main contractors which did not occur yet in this comprehensive measure, therefore all of the costs which will be claimed by the main contractors should be the responsibility of the government.
This will preclude the managerial normalization of the enterprises in Gaeseong Industrial Complex by inducing the conflict between the parties of South Korea, and this will clearly increase nothing but the distrust to the government policies. It shall be clearly understood that most of the damages which were imputed on the located enterprises will be expanded widely to the financial entities and numerous subcontractors thereof.
Thus, we hereby plead sincerely for the “100% compensation for the minimum amount verified/confirmed by the government” to prevent any expansion of the unavoidable damages to any other third parties and to let the enterprises located in Gaeseong concentrate in the normalization of their managements. Enterprises of Gaeseong Industrial Complex, Filed Unconstitutionality Litigation of ‘Total Suspension of Gaeseong Industrial Complex’ Against the Government
On May 9th, 2016, the enterprises located in Gaeseong Industrial Complex filed a constitutional complaint claiming to confirm that the total suspension measure of Gaeseong Industrial Complex of February 10th by the government was unconstitutional.
The enterprises which filed the constitutional complaint held a press conference at approximately 10:30 AM this day in front of the Constitutional Court at Jongno-gu District, Seoul City and revealed that “we have continuously requested to the government of North Korea to operate the Gaeseong Industrial Complex according to the principle of legalism but eventually our government totally suspended first the Gaeseong Industrial Complex without any legal basis, and therefore our government infringed the property right of our people which we always protected from North Korea” and added that “the purpose of this constitutional complaint is to verify and confirm that the February 10th measure of the government was unconstitutional because it infringed the legitimate procedures and the property rights of the people”.
The attorneys in charge of this litigation, GWANG GIL, KIM and JOO HEE, ROH (from Suryun Asia Law Firm) stressed that “this constitutional complaint is not claiming to verify if this total suspension measure of Gaeseong Industrial Complex was necessary for the public purpose such as national security or others”. They added that this constitutional complaint was “a litigation which claims for the judgment if the February 10th measure of the government had the proper procedure and form regulated by the national constitution and laws”.
The chairman GI SEOB, JEONG of the Corporate Association of Gaeseong Industrial Complex mentioned that “the act of verifying that the unconstitutional total suspension of Gaeseong Industrial Complex is a demonstration to North Korea that the legalism is working in South Korea”, and added that “the damages could have been minimized if the same measure has been taken through legitimate procedure for the located enterprises which were driven out to bankruptcy and the workers with high risk of voluminous dismissal”.
In this constitutional complaint there participated a total of 163 enterprises composed by 108 located enterprises of Gaeseong Industrial Complex (enterprises with local corporations within Gaeseong Industrial Complex), 37 enterprises operating in Gaeseong Industrial Complex (enterprises with operation/sales office in Gaeseong Industrial Complex) and 18 subcontractors within the Gaeseong Industrial Complex. Plea of the Entrepreneurs of the Gaeseong Industrial Complex
After 14 days of total suspension of the Gaeseong Industrial Complex, we the entrepreneurs of the Gaeseong Industrial Complex are suffering everyday which is like nightmare for us. We were concerned about the future of the companies which we could not find any other alternative or solution, therefore we begged and pleaded several times to let us ‘survive’, but the measure of the government was too far from our requests. The subcontractors are claiming everyday for payment of prices and compensation for damages, and thereafter there were disposed litigations and confiscations on us and we are unable to continue the normal corporate management accordingly.
Today, we the entrepreneurs held a general meeting of Emergency Measure Committee ‘to survive’ and to discuss together what to do in the future.
“Why should the Gaeseong Industrial Complex be closed?”, “Why the corporations must close the factories at once and be expelled compulsorily?”, “Why do we have to dismiss more than 2,000 workers?”, these plead and complaint of injustice turned into anger when we evidenced the petty alternative of the government.
Currently there is no practical or essential alternative of the government, and the compensation for 90% of the investment comprehended by the people is not performed in any manner. The people is understanding that the compensation for investment is the total compensation for all fixed and current assets. Due to the government subsidy, even the economic cooperation insurance is covering only few part of the amounts invested in fixed assets, there are numerous neglected and marginalized enterprises and the government is not mentioning a single word on the compensation for current assets (products and materials).
Because of the no-action of the government for the essential matter for the survival of the enterprises in Gaeseong, numerous entrepreneurs of Gaeseong are claiming for more active actions and they claim earnest appeal to the people is necessary. We the entrepreneurs of Gaeseong have delivered innumerable times these requests but there is no proper answer from the government.
Once again, we the entrepreneurs of Gaeseong hereby claim for the compensation for loss of the investments (for the fixed assets, products and materials) as promised by the President. And we claim for the practical sustenance measure for the workers of Gaeseong. Our claim and requests are for survival and we cannot give up until they are accomplished. In the coming March 2nd, we will hold an Emergency Measure Committee Meeting of Entrepreneurs of Gaeseong including the participation of our associated corporations and subcontractors.

Results of the 1st General Meeting of the Emergency Measure Committee of Enterprises Located in Gaeseong Industrial Complex
As we have held and proceeded the “Emergency Measure Committee General Meeting of Enterprises Located in Gaeseong Industrial Complex” today from 10:00 AM, we hereby announce its results as follows.
First, we discussed on the sustenance measure and employment of the corporate expats and relevant workers who have lost suddenly all their workplaces, and we the located enterprises decided to maintain as much as possible the employment.
As the located enterprises which suffered incalculable damage and have no revenues cannot maintain and continue the employment for long, we hereby urge to the government to prepare any effective alternative as soon as possible.
* The alternative announced by the government is only limited to the support in employment insurance which is applied equally for other domestic companies, and it is almost identical to the alternative of 2013 as there has been added a little amount of loan for the sustenance of the corporate expats.
Second, as the Emergency Measure Committee has resolved to investigate the actual damages suffered by the enterprises to discuss on the compensation for damages and relevant alternatives, the Committee has decided to distribute relevant materials to all located enterprises and perform the survey on current damages as soon as possible. Our Position on the Total Suspension of Gaeseong Industrial Complex
Today, at 2 o’clock of the afternoon we were informed by the minister of unification on the measure of total Suspension of the Gaeseong Industrial Complex. We commune with the stringent situational awareness of the government for the nuclear experiment and launching of long-range missile by North Korea, but the entrepreneurs who were informed unilaterally on the total Suspension of the Gaeseong Industrial Complex during the lunar new year holidays as if there were a military operation, consider it as nothing but an unfair and unjust measure.
We the enterprises located in Gaeseong Industrial Complex have made all possible efforts believing the agreement-commitment of Park Geun-Hye administration that “the safe access of southern personnel, the normal operation of northern workers, the protection of corporate assets and the normal operation of the complex shall be guaranteed in any circumstance regardless of the political conditions” as stated in the clause 1 of the [agreement for normalization of Gaeseong Industrial Complex] which consisted in an agreement to reoperate the Gaeseong Industrial Complex on august 14th, by the representatives of the two Koreas after the Suspension of the complex since the 3rd nuclear experiment in 2013.
With this belief, even with the limitation of access by the government due to the 4th nuclear experiment and long-range missile launch experiment, we endured all difficulties with the belief in our government and made all possible efforts to minimize the damages and losses.
But the government did not provide any time off to minimize the damages on the enterprises before taking the measure of total Suspension, but took suddenly the decision of total Suspension and pushed the enterprises to the brink.
Therefore, we the enterprises located in Gaeseong Industrial Complex shall organize an emergency measure committee in the future and shall strongly respond against the unjust measure of the government which is the total Suspension of Gaeseong Industrial Complex. FIN.
